Enforcing Standards for Employees
Under the federal Fair Labor Standards Act (FLSA), in conjunction with Indiana and Kentucky employment laws, most employees are entitled to be paid a minimum wage of $6.55 per hour and an overtime wage of time and a half (50 percent more than the employee's average hourly pay) for every hour worked over 40 in a single week.
There are also federal and state laws regarding when you must be paid what you are owed. If you have left your job and haven't gotten your last paycheck yet, or if your employer is refusing to compensate you for vacation pay, sick pay, personal time or bonuses, you may have legal rights that can be enforced.
Determining What You Are Entitled To
Federal and state legal standards for payment of overtime wages are much more complex than many people — including many employers — realize.
You cannot be denied overtime simply because you are paid on a salary basis, given a particular job title or placed in a certain category of employees. Nor can you, in most cases, sign away your right to overtime. Your entitlement to an overtime wage is based on your actual day-to-day work duties, as well as your overall income.
